Can an American Buy Safely in Mexico?
Yes! Like in the United States there are rules and laws to follow. If you want to buy in the 'Prohibited or Restricted Zone' which is 50 Kilometers along the Ocean front and 100 Kilometers along the International land borders of Mexico, you must use a trust or in Mexico it is called a Fedeicomiso. A straight Title Transfer is simply the sale of the Mexican Real Estate by the Seller to you the Buyer. You both sign the Public Instrument prepared and executed by a Notary Public (Notario Publico) which contains the sales contract and title transfer.
We have over simplified the process and there are other avenues available to own property in Mexico. However, what ever you do you MUST have an experienced person assist you, that way when you decide to buy in Mexico your investment will be a secure one.
Remember, Mexican investors have the same concerns buying in the United States as you do in Mexico.

Pricing and The Exchange Rate.

What is the difference between prices with the exchange rate?

The Peso has been fluctuating. Presently the exchange rate is approximately about 10 to 1 (that is 10 pesos to one American dollar).
Your American dollar can go a long way in locating a facility, land or vacation home in Mexico.
Your Company can buy a great facility and pay a very resonable rate for labor in Mexico.
If your Company is labor intensive, Mexico may be the answer for you!

How Can I Finance My Move?

Numerous programs exist to help your financing needs from both the United States and Mexico. The World Bank is just one source that has a history of lending in other countries.
If your company has a good history, a well thought out plan that will benefit the local economy (U.S. and/or Mexico) and a client base to draw from, then you have a good chance of finding the finance you need.

Property Inspections

How Can I Arrange a Property Inspection Before Buying or Leasing?

We will put you in contact with the property owner or his representatives to walk, view and photograph the property.
If you would like to inspect Documents on certain properties you are interested in, such as; Title Documents (Titulos de Prepiedad), Public Instrument (Escritura Publica), Public Registry of Property (Registro Publico de la Propiedad) and other information, we can provide information to help you locate and research the property, title and the current ownership status.
This is primarily done through a Notery Public.
This work through the Notery can also include the Preliminary Sales Agreements (Contrato de Promesa de Venta) which neccessary to enter into an agreement for the purchase of the property for your inspection.
We can be your link to finding out the necessary information to make a safe and secure purchase in Mexico.

Closing Costs

Who Pays The Closing Costs?

The Notary Public will calculate the commissions, fees to attorneys, fees and expenses to the Notary Public, taxes and government rights for the transfer (can be up to 10% of sales price), bank costs, federal income tax on transfer, added value tax on commercial constructions, rights of registgry at the public registgry of property, bank appraisal, certificat of no debt for land holding tax, certificate of non encumbrances, permit from the Ministry of Foreigh Affairs, Public instrument expenses and the sales price.
This Notary Public will be a very important contact and the one responsible to pay 'the bills'. He will provide you with a receipt for your portion of these cost. These costs can be split with the Seller.
The Notary Public is an Attorney with three years experience working for a Notary Public before he is eligible to apply for a position of 'Notary Public'.
