Coupon Settlement Proposed in Lieu of TCPA Damages

PJI Fax Settlement Challenged
|
A state court in San Mateo County, California, has approved a class action settlement that would provide discount coupons to 112 people and erase the rights of thousands of fax recipients under the TCPA to receive $500 per unsolicited fax advertisement from Perry Johnson, Inc.
The proposed settlement in Hypertouch v. Perry Johnson, Inc. has been challenged by an "objector," who has now appealed. A hearing date in the appeal is expected during 2008.
The appeal claims that the court failed to follow directions from a higher court to notify the class members, and wrongly found that insurance coverage did not apply.
