Subject: U.S. District Court Local Rules -- Proposed Amendments

You were selected to receive this e-mail based on your listing in the 2009 Montana Lawyers' Desk Book & Directory as the contact person for a local bar association or a professional association.

The United States District Court for the District of Montana asks for your help in notifying your members of proposed changes to the District's Local Rules of Procedure. Proposed amendments are now available for public review and comment.

Important changes to the Federal Rules are made this year as well. Many deadlines are altered, in the Rules and in many federal statutes, and so is the manner of calculating time. These changes will affect deadlines and time calculation in every federal court, not just in Montana, beginning on December 1, 2009.

Linked below are two documents. One is an announcement concerning the time calculation changes to the Federal Rules and amendments to the Local Rules. The second document is a complete copy of the Local Rules showing proposed amendments. In the Table of Contents, the title of each rule proposed for amendment is underlined and shown in larger font. Proposed additions are underlined; a line runs through proposed deletions. Comments briefly explaining the reason for the proposed amendment are included.

(Comments are not submitted to the judges for their approval and will not be part of the Rules as adopted after the public comment period.)

These documents are also available on the Court's website, www.mtd.uscourts.gov, under "Documents" and "Local Rules."

Please ask your members or constituents to direct comments to mtd_localrulescomments@mtd.uscourts.gov. The deadline is 5:00 p.m. on Tuesday, September 15, 2009. If adopted by the Judges of the District of Montana, the proposed changes will go into effect on December 1, 2009.

Changes to the Federal Rules will go into effect on that date too.
