Subject Juvenile "girl-drama" Charged

Date Wed Mar 9 2011 09:22
Author Sue (dbdon1601@yahoo.com)

Am looking for thoughts on how the Juvenile system works.
Step-daughter (age 16), Dad, Self received (3) sets of Summons for Juvenile Delinquency Petition. Count: 1. Disorderly Conduct - Brawling or Fighting(Misdemeanor) in Violation of: 609.72 subd. 1(1) MOC Code: N3030 --- ??? on Summons, her address lists wrong County, can I as step-parent be Summoned also this came from different County as it was referred because other girls' parent works in Sheriff Dept although the Summons is for our County)

Situation: Mid-Dec. another girl (the two have nit-picked in past couple years over boys, looks, etc.)In past yr have been CLEAR with daughter to "stay away", try not to be around, etc..(small school hour from cities). One night other girl posts litiny on Facebook she is looking forward to a "3-day Suspension" cuz' she "has a plan" comments on "kick some ***", "good luck with your fight". Next day daughter avoids her all day, end of day has to walk past her locker to get to next class, walks on other side of hall (shown in school video)... girl comes forward with uncapped fast food pop and throws at her- stepdaughter deflects, girl pulls her by hair to ground. Police Report says girl admitts to throwing pop, getting on daughter, punching & hitting her (but she states after throwing the pop on her, daughter came at her). Police Report states that daughter said girl did pop, attacked her, after being hit or punched as wasn't sure open hand or fist -- she tried to get away and was hitting her to do so. Other girl report says, had "small scatch on left little finger", "small scratch by left eye and by ear piercing". Daughter had no immediate signs, (later nose was swollen, slightly discolored... no big deal. THAT night other girl posts on Faecbook "Yea, yea, kicked *** Suspended but well worth it" with a smiley face.

Police tried calling Dad once, did not get him and spoke/interviewed daughter (Report states that). School suspended both girls 3 days but after reading "plan posted" rescinded for daughter with letter stating she was unwilling participant. District Attorney/Police given copies of other girls Facebook postings etc..

So - as I read it, UNTIL she Pleads guilty or Judge finds her guilty... no one but an Attorney can speak or help her in Court?? Is there a chance Judge will look at this and simply "Dimiss". Should we go to this and have her plead guilty then hire Attorney IF it is persued to Trial or do we need to consult before first hearing??

Financially we are struggling (as many) very much... BUT do not want to see "life-long" consequences that we foolishly did not understand the Court system here.

Sorry so long but any help on:
**IF we can reasonably wait until after this first Court date to see if it will go away without further cost, would be great??
**Can this be Assault when one is engaged in a planned attack?
**Also, is there a way for us to find out if other girl was charged too and/or with what??
THANKS SO MUCH!!!
(side note- find it amusing or frustrating that so much time, paper, effort cost by court system is being spent on this plus forcing (non)juvenile delinquent to miss school for Court Hearing(s), after, as Parents, we took the time off work etc to deal with it then- so she wouldn't miss school time... ironic it seems!)
